Cannabinoid hemp industry to face new, stricter guidelines

Hemp-derived CBD sellers and producers will soon have to comply with rules several years in the making

ALBANY — The Office of Cannabis Management on Wednesday adopted regulations designed to set stricter standards for New York’s exploding hemp market, requiring all hemp-derived cannabinoid products – such as trending CBD oils and salves – to meet state manufacturing, laboratory, packaging and labeling guidelines.

Some of the new rules, including those for packaging and lab testing, will take effect in six months to allow processors and retailers time to bring their operations into compliance.

New York has 25 fully permitted cannabinoid hemp processors, and the Office of Cannabis Management has approved another 71 provisional licenses for processors and manufacturers. They have also provisionally approved 403 permits for wholesale distribution of out-of-state products, and 2,384 for retailers. 

An OCM spokesman said there is no cap on the number of cannabinoid hemp licenses they will approve, and the agency will finalize the provisional permits in the coming weeks.

Cannabis Control Board member Jen Metzger, who presented the latest program updates at the board’s third public meeting Wednesday, explained that the first package of proposed regulatory changes was put forward in October 2020.

Metzger, a former state senator, sponsored the law that originated the package, which was passed by the Legislature in 2019. She said that the rules adopted Wednesday had last been updated in May 2021 to account for provisions in this year’s Marijuana Regulation and Taxation Act, including allowing the sale of whole flower.
